DEFENSE OF EXCUSABLE HOMICIDE -

ACCIDENT AND MISFORTUNE - LAWFUL ACT

A homicide is excusable when committed by lawful means, with usual and ordinary caution, and without any unlawful intent, but occurs by accident and misfortune while doing some lawful act.
