KILLING POLICE DOG/HORSE
DURING COMMISSION OF CRIME - ELEMENTS
No person may be convicted of killing a police dog/horse during the commission of a misdemeanor/felony unless the State has proved beyond a reasonable doubt each element of the crime. These elements are:
First, knowingly;
Second, willfully;
Third, without lawful cause or justification;
Fourth, killing;
Fifth, a police dog/horse;
Sixth, owned/used by;
Seventh, a law enforcement agency [of a political subdivision] of the State;
Eighth, during the commission of a misdemeanor/felony.
